On April 15, 2025, Garcia expressed his concerns regarding actions by Homeland Security agents and a constitutional crisis involving a refusal to comply with a Supreme Court order.
On April 15, 2025, Congressman Robert Garcia highlighted a troubling incident involving Homeland Security agents who attempted to enter two elementary schools without warrants in his district. He mentioned that these agents lied about having the necessary permission to speak with students. Garcia called for accountability from the Secretary of Homeland Security, Kristi Noem.
Later the same day, he addressed a constitutional crisis, stating, "We are in a constitutional crisis, where the President is openly defying the Supreme Court’s order to bring back Kilmar Abrego Garcia from El Salvador." Garcia, along with Rep. Maxwell Frost, requested the Oversight Committee's approval to send a delegation to El Salvador immediately.
Continuing his focus on this issue, on April 16, 2025, Garcia reiterated his stance on the situation involving Kilmar Abrego Garcia. He described Donald Trump's refusal to comply with the court order as a constitutional crisis and urged Congressional action. He called upon Rep. James Comer to authorize a delegation to ensure Garcia's safety and facilitate his return from El Salvador.
